PERSONAL DATA PROTECTION AND CONSUMER PRIVACY RIGHTS NOTICE

Elite Interiors USA respects the privacy of its customers, website visitors, delivery recipients, and other individuals who interact with our business.

2. SCOPE OF THIS NOTICE

This Notice applies to personal information collected or processed when an individual:

  • places an online, telephone, or in-store Order;

  • purchases or returns a Product;

  • receives a shipment or delivery;

  • communicates with customer support;

  • submits a review, photograph, question, or testimonial;

  • participates in a promotion;

  • visits our physical retail location; or

  • otherwise interacts with Elite Interiors USA.

This Notice does not apply to personal information processed independently by third parties whose websites, applications, platforms, payment systems, financing services, or other services are governed by their own privacy notices.

Complete payment card numbers and security codes are generally processed by authorized payment providers and are not ordinarily stored directly by Elite Interiors USA.

4.9 Inferences and Preferences

We may derive limited information concerning:

  • Product interests;

  • furniture style preferences;

  • shopping preferences;

  • likely Product categories of interest; and

  • engagement with our website or advertising.

5. SENSITIVE PERSONAL INFORMATION

Elite Interiors USA does not ordinarily request sensitive Personal Information that is unnecessary for a furniture purchase.

Limited sensitive information may be processed when reasonably necessary, including:

  • account login credentials;

  • government-issued identification presented for fraud prevention or pickup verification;

8. PRINCIPLES OF PERSONAL DATA PROTECTION

8.1 Transparency

We seek to provide understandable information about the Personal Information we collect, the purposes for which it is used, and the categories of persons to whom it may be disclosed.

8.2 Purpose Limitation

We process Personal Information for legitimate business, transactional, security, legal, and customer service purposes described in our notices.

8.3 Data Minimization

We seek to collect and retain only the Personal Information reasonably necessary for the relevant purpose.

9. LEGAL AND BUSINESS GROUNDS FOR PROCESSING

United States privacy laws do not always use the same legal-basis structure used in other jurisdictions.

Depending on the applicable law and the circumstances, we process Personal Information because:

  • processing is necessary to complete a transaction requested by the Individual;

  • processing is necessary to perform our obligations under a sales agreement;

  • processing is necessary to provide a requested service;

  • processing is required to comply with law;

11. SALE, SHARING, AND TARGETED ADVERTISING

Elite Interiors USA does not knowingly sell Personal Information in exchange for direct monetary payment.

Certain uses of advertising cookies, pixels, analytics tools, or advertising platforms may nevertheless be considered a “sale,” “sharing,” or processing for “targeted advertising” under the broad definitions used by some state privacy laws.

Where applicable, eligible Individuals may opt out of:

We do not knowingly sell or share the Personal Information of children under 16 for targeted advertising.

12. CONSUMER PRIVACY RIGHTS

Depending on the Individual’s state of residence, the nature of the Personal Information, the purpose of processing, and whether Elite Interiors USA is subject to the applicable law, an Individual may have the right to:

12.1 Right to Know

Request information about:

  • the categories of Personal Information collected;

  • the sources of Personal Information;

  • the purposes of processing;

  • the categories of recipients;

  • the categories of Personal Information sold or shared, if any; and

  • the retention or processing practices applicable to the information.

12.2 Right of Access

Request access to Personal Information maintained about the Individual.

12.3 Right to Obtain a Copy

Request a portable copy of Personal Information where required by applicable law and technically feasible.

12.4 Right to Correction

Request correction of inaccurate Personal Information.

12.5 Right to Deletion

Request deletion of Personal Information, subject to applicable exceptions.

We may retain information when reasonably necessary to:

  • complete a transaction;

  • provide a requested Product or service;

  • process a return, refund, or warranty;

  • maintain tax and accounting records;

  • prevent fraud;

  • protect security;

  • comply with law;

  • exercise legal rights; or

  • establish or defend a legal claim.

12.6 Right to Opt Out

Eligible Individuals may request to opt out of:

  • sale of Personal Information;

  • sharing for cross-context behavioral advertising;

  • targeted advertising; or

  • certain profiling that produces legal or similarly significant effects.

12.7 Right to Limit Certain Uses of Sensitive Information

This right may not apply where sensitive information is used only for permitted purposes such as completing transactions, preventing fraud, maintaining security, or providing requested services.

12.8 Right to Withdraw Consent

Where processing is based on consent, the Individual may withdraw consent as permitted by applicable law.

12.9 Right to Appeal

Residents of certain states may appeal a decision denying a privacy request.

12.10 Right to Nondiscrimination

We will not unlawfully discriminate against an Individual for exercising an applicable privacy right.

13. RIGHTS ARE SUBJECT TO APPLICABLE LAW

Privacy rights vary by state.

A listed right applies only when:

  • the applicable state law grants that right;

  • the law applies to Elite Interiors USA;

  • the Individual and Personal Information are covered by the law;

  • no statutory exception applies; and

  • the request can be reasonably verified.

The inclusion of a right in this Notice does not represent that every state law applies to Elite Interiors USA or that every Individual is entitled to every listed right.

We may voluntarily honor a reasonable request even when we are not legally required to do so.

The request should:

  • clearly state that it is a privacy request;

  • identify the right being exercised;

  • provide sufficient contact information;

  • describe the relevant account, transaction, or interaction; and

  • identify the state of residence.

Individuals should not send complete payment card numbers, account passwords, Social Security numbers, or unnecessary identification documents by ordinary email.

15. IDENTITY VERIFICATION

Before fulfilling certain privacy requests, we may need to verify the requester’s identity.

Verification may require information such as:

  • name;

  • email address;

  • telephone number;

  • billing or shipping address;

  • Order information;

  • account verification; or

  • other information reasonably connected to the Consumer’s relationship with us.

We will request only information reasonably necessary for verification.

Information obtained for verification will be used to:

  • process the request; and

  • maintain legally required records.

We may deny a request if we cannot reasonably verify the identity or authority of the requester.

16. AUTHORIZED AGENTS

Where permitted by applicable law, an Individual may authorize another person to submit a privacy request on the Individual’s behalf.

We may require:

  • written authorization signed by the Individual;

  • proof that the agent is registered where registration is required;

  • verification of the agent’s identity;

  • verification of the Individual’s identity; and

  • direct confirmation that the Individual authorized the request.

We may deny an agent’s request when the required authorization or verification is not provided.

17. RESPONSE PERIOD

We will acknowledge and respond to verified privacy requests within the period required by applicable law.

Where legally permitted and reasonably necessary, we may extend the response period.

If an extension is required, we will provide notice and explain the reason where required by law.

We generally do not charge a fee for processing privacy requests.

Where permitted by law, we may charge a reasonable fee or refuse to act when a request is:

  • manifestly unfounded;

  • excessive;

  • technically unreasonable;

  • repetitive; or

  • submitted for an abusive or fraudulent purpose.

18. APPEALING A DECISION

Where applicable state law provides an appeal right, an Individual may appeal a denial by contacting:

The appeal should:

  • state that it is a privacy appeal;

  • identify the original request;

  • explain why the decision should be reconsidered; and

  • provide any additional relevant information.

We will review and respond to the appeal within the period required by applicable law.

If the appeal is denied, we will provide information about any additional complaint rights required by the applicable state law.

19. GLOBAL PRIVACY CONTROL AND OPT-OUT SIGNALS

Where required by applicable law and supported by our systems, we will process recognized browser-based universal opt-out signals, including Global Privacy Control, as an opt-out request for the browser or device sending the signal.

Browser-based signals may apply only to the browser and device from which they are sent.

The Individual may need to activate the signal separately on each browser and device.

20. DATA RETENTION

We retain Personal Information only for as long as reasonably necessary for the purposes for which it was collected or as otherwise required or permitted by law.

Retention periods may depend on:

  • the duration of the customer relationship;

  • transaction and Order requirements;

  • delivery completion;

  • return and warranty periods;

  • tax and accounting requirements;

  • fraud prevention requirements;

  • security needs;

  • legal obligations;

  • applicable limitation periods;

  • pending claims or disputes; and

  • contractual obligations.

When Personal Information is no longer reasonably required, we may:

  • delete it;

  • anonymize it;

  • aggregate it;

  • securely destroy it; or

  • isolate it from ordinary use until deletion is technically possible.

21. DATA SECURITY

We maintain reasonable administrative, technical, and physical measures designed to protect Personal Information.

23. CHILDREN’S INFORMATION

Our website is not directed to children under 13.

We do not knowingly collect Personal Information online from children under 13 without legally required parental consent.

Individuals under 18 should not create an account or make a purchase without the involvement of a parent or legal guardian.

If we learn that Personal Information was collected online from a child under 13 without legally required consent, we will take reasonable steps to delete it.

24. INTERNATIONAL DATA PROCESSING

Elite Interiors USA is located in the United States.

Shopify and other Service Providers may process or store Personal Information in the United States or other countries in which they operate.

Privacy laws in those jurisdictions may differ from the laws of the Individual’s country or state.

Where applicable law requires additional safeguards for an international data transfer, we will use legally recognized measures appropriate to the transfer.

A revised Notice will not retroactively reduce legally protected rights concerning Personal Information previously collected when doing so would violate applicable law.
